flightlogbook.cloud
Terms and Conditions
§ 1 Provider and scope
- The provider is ZCS GmbH, Schulgasse 90/40, 1180 Vienna, Austria, company register FN 600271 b, Commercial Court Vienna, VAT ID ATU79240135, email support@flightlogbook.cloud (“provider”, “we”).
- These terms apply to all contracts for the use of flightlogbook.cloud (web application, programming interfaces and related services, “service”) between the provider and its customers.
- Customers are consumers within the meaning of the Austrian Consumer Protection Act (KSchG) or businesses. Provisions that apply only to consumers or only to businesses are marked as such.
- Deviating terms of the customer do not apply, even if we do not expressly object to them.
§ 2 Registration, conclusion of contract and trial
- Use requires a user account. When registering, the customer provides true and complete information and confirms their email address.
- Completing the registration concludes a free contract of use for a trial period of 90 days. No payment details are needed for the trial.
- If an existing customer invites the customer, the trial of the invited person and the subscription of the inviting customer are each extended by the time stated in the service (currently 6 months).
- A paid subscription is concluded when the customer selects a term in the service, clicks the button to order with obligation to pay, and the payment is completed. We confirm the contract by email and provide the invoice in the service.
§ 3 Services
- The service is an electronic logbook for pilots. It includes in particular: recording flights and simulator sessions, aircraft and aerodromes; licences, ratings and medical certificates with reminders; statistics and evaluations of flight experience and privileges; PDF reports; document storage; features for instructors and students; import and export; and interfaces (API, MCP, webhooks). The current scope is described in the service.
- We run the service on our own servers in our own datacenters in Austria; the data is mirrored to a second datacenter in Austria.
- The service is available at least 95 % of the time on annual average. Announced maintenance and disruptions outside our control (such as the customer's own internet outage) do not count as downtime. We announce maintenance in advance where possible.
- We may develop the service further and change features, provided the essential contractual services remain and the change is reasonable for the customer.
§ 4 Customer obligations
- The customer keeps their login details, API tokens and passkeys secret and informs us without delay if misuse is suspected.
- The customer is responsible for the accuracy of their entries. If they enter data of third parties (such as names of instructors, passengers or students), they make sure they are entitled to do so.
- The customer does not misuse the service, in particular not to overload the systems, circumvent security measures or store unlawful content.
§ 5 Aviation notices
- Calculations of the service (such as flight experience, recency, validity of licences, ratings and medical certificates, or flight duty and rest times) are aids. They do not replace the pilot's own checks. Responsibility for complying with aviation regulations (in particular Part-FCL and Part-MED) remains with the pilot.
- The requirements shown (such as recency and revalidation conditions, experience requirements for licences and ratings, validity periods of medical certificates, and flight duty and rest limits) are a simplified and non-exhaustive summary of the regulations as we understood them when we implemented them. Regulations change and apply with national deviations, exemptions, crediting rules and operator requirements that the service does not fully reproduce. Every calculation also depends on the customer's entries being complete and correct. We therefore do not guarantee that the requirements and progress shown are complete, correct or up to date. A status shown as met, valid or current does not mean that the requirements are actually met.
- Only the applicable regulations, the pilot's licence and medical documents, and the information given by the competent authority, the examiner or the operator (for example its approved flight time limitation scheme) are authoritative.
- Whether an authority or examiner accepts an electronic logbook, its printouts or electronic confirmations by instructors is decided by that body. We do not guarantee such acceptance.
- Weather data (METAR/TAF) comes from third parties and serves documentation only, not flight preparation.
§ 6 Prices, payment and term
- The prices and terms shown in the service at the time of the order apply. The subscription currently costs EUR 33.33 net per 12 months; for customers in Austria EUR 40.00 including 20 % VAT. Consumers in other EU member states pay the net price plus the VAT of their country of residence. Businesses with a valid VAT ID in another EU member state receive an invoice without VAT (reverse charge); outside the EU no Austrian VAT is charged.
- The subscription is paid in advance for the term chosen in the order (currently 12, 24 or 36 months; longer terms include the bonus months stated in the service). Payment is processed by the payment provider Stripe.
- The subscription does not renew automatically. It ends when the paid term ends. The customer can extend it at any time with a new order; the new term follows on from the current one.
- After the term ends, the account remains. Entries are then read-only; the customer can still view and export their data.
- We provide invoices electronically in the service. The customer agrees to electronic invoicing.
§ 7 Right of withdrawal for consumers
- Consumers may withdraw from a distance contract within 14 days of its conclusion without giving reasons. The deadline is met if the withdrawal is sent before it expires.
- Withdrawal can be declared with the “Withdraw from contract” button under Invoices in the service, by email to support@flightlogbook.cloud, or in writing to the address in § 1, for example with the model form in the annex.
- If the consumer expressly requests that we start the service before the withdrawal period ends and then withdraws, they pay an amount proportionate to the service provided until the withdrawal, relative to the total price (§ 16 FAGG).
- On withdrawal, we refund payments received, less any amount under paragraph 3, within 14 days using the same means of payment.
§ 8 Customer data, export and deletion
- The data the customer enters remains theirs. We use it only to provide the service and as described in the privacy policy.
- The customer can export their data at any time, also after the subscription ends, in common formats (CSV, JSON, PDF, original files of documents).
- The customer can delete their account at any time in the profile. Their data is then deleted, except invoices that we keep because of statutory retention duties.
- If the customer wants to switch to another provider, we support them under Regulation (EU) 2023/2854 (Data Act), in particular through the export in paragraph 2. We charge no switching fees.
- We back up the data regularly. The customer is nevertheless advised to export important data regularly.
§ 9 AI features and interfaces
- The optional scan of paper logbook pages sends the uploaded image to an AI service provider (currently Anthropic, USA) to recognise the entries. It runs only when the customer expressly starts it. Recognised entries must be checked before they are taken over.
- Through API tokens, the MCP interface and webhooks, the customer can give third-party applications (including AI assistants of their choice) access to their data. The customer is responsible for these applications and for passing data to them.
§ 10 Warranty
Statutory warranty applies. For consumers, in particular the provisions of the Austrian Consumer Warranty Act (VGG) on digital services apply. The customer reports defects as precisely as possible, for example with “Report a problem” in the service.
§ 11 Liability
- Towards consumers, we are liable under the statutory provisions. Liability for slight negligence is excluded, except for personal injury and for damage to items we have taken over for processing.
- Towards businesses, we are liable only for intent and gross negligence, except for personal injury. Liability is capped at the fees the customer paid in the last 12 months; we are not liable for lost profit or consequential damage.
- Mandatory liability under the Product Liability Act and the GDPR remains unaffected.
§ 12 Termination and suspension
- The customer can end the contract at any time by deleting their account. Fees already paid are not refunded, except in the case of withdrawal under § 7 or where mandatory law provides otherwise.
- We can terminate the contract with three months' notice. We refund fees already paid for the time after the end of the contract pro rata.
- In the case of serious breaches of § 4, we can temporarily block access or terminate the contract for good cause without notice. Before terminating, where reasonable, we give the customer the opportunity to respond and to export their data.
§ 13 Changes to these terms
- We inform customers of changes to these terms in good time beforehand by email and in the service.
- Towards consumers, changes take effect only if the consumer expressly agrees to them, for example with the “Accept” button in the service. If they do not agree, the previous terms continue to apply until the end of the paid term.
- Towards businesses, changes are deemed accepted if the business does not object within six weeks of the notice; the notice points this out. If the business objects, either side can terminate the contract as of the date the change takes effect.
§ 14 Transfer of contract for existing customers
Until 31.10.2026, the service was operated by EDV Consulting Zoichter GmbH (FN 372020 p, Regional Court Klagenfurt). By accepting these terms, an existing customer agrees that ZCS GmbH takes over the existing contract with all rights and obligations. ZCS GmbH operates the service from 01.11.2026. Paid terms and stored data remain unchanged.
§ 15 Data protection
Our privacy policy describes how we process personal data.
§ 16 Final provisions
- Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. Consumers keep the protection of the mandatory provisions of the law of their habitual residence.
- For businesses, the place of jurisdiction is the competent court in Vienna. For consumers, § 14 KSchG applies.
- We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
- If a provision is invalid, the rest of the contract remains valid.
- These terms are available in German and English. If the versions differ, the German version prevails.
